HAMILTON TOWNSHIP, N.J. -- A Mercer County homeowners association has notified an Army veteran that he will be fined $25 for each day he flies a POW-MIA flag outside his house.

On Friday, Ralph McIlvaine received letters telling him the Evergreen development had denied his application to fly the flag and ordered him to take it down, News 12 New Jersey reported.

The $25-a-day penalty takes effect Tuesday. The Evergreen development allows residents to fly flags only for the United States and the state of New Jersey.

Mayor Glen Gilmore has asked the president of the homeowners association, John Periano, to allow the POW-MIA flag and waive the fines. Periano told News 12 that he has not yet spoken to all the board members.

McIlvaine said the flag will still be outside his house Tuesday morning, with or without a fine.

"I didn't mean to ruffle anybody's feathers or break any rules, but the flag is important to me, as I think it is to others in my development," he said.
